Welcome to PoolDial, operated by Idappaccayata, LLC. These Terms of Service ("Terms") govern your access to and use of our AI phone answering service. By using PoolDial, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using PoolDial, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our service.

2. Description of Service

PoolDial provides an AI-powered phone answering service designed for pool service professionals. Our service includes:

• 24/7 automated phone answering
• Call recording and transcription
• Message capture and routing
• Email and SMS notifications
• Dashboard access to call history and analytics

3. Account Registration

To use PoolDial, you must:

• Be at least 18 years old and legally able to enter into contracts
• Provide accurate, current, and complete account information
• Maintain the security of your account credentials
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized access

4. Call Recording Compliance

You are solely responsible for compliance with all applicable laws regarding call recording, including:

• Obtaining necessary consent from callers where required by law
• Providing appropriate disclosures and notifications
• Understanding and complying with federal, state, and local recording laws
• Informing callers that calls may be recorded

PoolDial does not provide legal advice. You should consult with legal counsel regarding call recording requirements in your jurisdiction.

5. Acceptable Use

You agree not to use PoolDial to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, fraudulent, or deceptive content
• Harass, abuse, or harm others
• Interfere with or disrupt the service
• Attempt to gain unauthorized access to our systems
• Use the service for telemarketing or spam
• Resell or redistribute our service without authorization

6. Pricing and Payment

Subscription Plans

• Pricing is based on your selected plan and usage
• You authorize us to charge your payment method on a recurring basis
• Prices may change with 30 days' notice
• All fees are non-refundable except as required by law

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

7. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We are not liable for:

• Scheduled maintenance or updates
• Service interruptions beyond our control
• Missed calls during outages
• Third-party service failures (phone carriers, internet providers)

8. Data and Privacy

Your use of PoolDial is also governed by our Privacy Policy. We:

• Store call recordings and data according to your retention settings
• Process data to provide and improve our service
• Do not sell your personal information
• Implement security measures to protect your data

9. Intellectual Property

PoolDial and its content, features, and functionality are owned by us and protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or create derivative works of our service
• Reverse engineer or attempt to extract source code
• Remove proprietary notices or labels

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOLDIAL SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOST PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• MISSED CALLS OR LOST CUSTOMERS
• DATA LOSS OR CORRUPTION

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Warranty Disclaimer

POOLDIAL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The service will be error-free or uninterrupted
• Defects will be corrected
• The service will meet your specific requirements
• AI responses will be accurate or appropriate in all situations

12. Indemnification

You agree to indemnify and hold harmless PoolDial from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of applicable laws, including call recording laws
• Your violation of third-party rights

13. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay required fees
• Use the service in a manner that harms others or our systems

Upon termination, your right to use PoolDial ceases immediately.

14. Modifications to Terms

We may update these Terms from time to time. We will provide notice of material changes via email or through our service. Continued use after changes constitutes acceptance.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, conducted in Arizona, except where prohibited by law. You and PoolDial agree to submit to the personal jurisdiction of the courts located within Arizona for any actions for which the parties retain the right to seek injunctive or other equitable relief.

16. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and PoolDial
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• No Waiver: Our failure to enforce any right does not waive that right
• Assignment: You may not assign these Terms without our consent
